1 Whoever imports or places on the market a raw material, whether pure or mixed into a composite or dietetic feedstuff which is neither exempt from the announcement obligation under paragraph 2 nor entered on the FOAG list in accordance with paragraph 3 shall, within three months of first import or placement on the market, notify FOAG of the following information:
a. name and address of person or undertaking placing the raw material on the market or importing it;
b. name and any specific labellings of raw material;
c. description of raw material and data on the process from which the raw material is obtained and, where applicable, the manufacturing process;
d. main nutrients in the raw material.
2 The EAER shall determine which raw materials do not have to be notified. In doing so, it shall rely on European Union law.
3 FOAG shall publish a list of notices issued.
4 The name of a raw material listed in the raw materials catalogue, contained in a composite or dietetic feedstuff, as the case may be, shall only be used if all the applicable provisions of that catalogue are complied with.
5 A raw material appearing in the raw materials catalogue which, in accordance with the therapeutic products legislation, would be treated as a therapeutic product shall not be imported, placed on the market or used as a raw material for animal feedstuffs. FOAG may provide for exceptions.
