1 The FDHA shall keep a register of all persons practising a university medical profession.
2 This register shall serve for patient information and protection, quality assurance, statistical purposes, compilation of medical demographics and information to foreign authorities. It shall have the further purpose of streamlining the procedures necessary for licensing to practise and enabling the cantons to exchange information on disciplinary measures imposed.
3 The register shall contain the data necessary to achieve the purposes listed in paragraph 2. The register shall also include sensitive data in accordance with Article 5 of the Federal Act of 25 September 2020 on Data Protection.
4 The register shall in particular contain the information necessary for the cantons and federal bodies in the context of implementation of the Federal Act of 18 March 1994 on Health Insurance.
5 The Federal Council shall issue provisions concerning the personal data contained in the register and how to process them.
Article 53 MedPA Data disclosure
1 The data concerning disciplinary measures and the reasons for refusal or withdrawal of licensing, by virtue of Article 38 paragraph 1, may only be accessed by the authorities responsible for licensing to practise and by the supervisory authorities.
2 The FOPH shall pass information to the authorities responsible for current disciplinary procedures, at their request, on the data concerning lifted restrictions and temporary bans from practising marked “deleted.”
3 The OASI number shall not be publicly accessible; it shall only be accessible to the authority responsible for keeping the register and to the cantonal authorities responsible for licensing to practise.
4 All other data shall be accessible to the public online.
5 The Federal Council may require certain data to be accessible only on request if it is not in the interest of public health to make them accessible to the public online.
Article 10 Ordinance concerning the MedPA Register - Communication of public data
1 The public data shall be accessible online or on request.
2 The data accessible only on request shall be identified as such in Annex 1.
Article 23 of the Act on Healthcare Occupations - Responsibilities and purpose
1 The Federal Office of Public Health (FOPH) shall keep the Healthcare Occupations Register (register).
2 The register shall serve:
a. for patient or client information and protection;
b. for quality assurance;
c. for statistical purposes;
d. for the information of Swiss and foreign authorities;
e. for the streamlining of the procedures necessary for licensing to practise; and
f. for inter-cantonal information exchange on disciplinary measures imposed.
3 The Federal Council may allocate the keeping of the Register to third parties. The third parties may charge fees for their services.
Article 24 of the Act on Healthcare Occupations - Contents
1 The following persons shall be registered:
a. holders of diplomas in accordance with Article 12 paragraph 2 or of a recognised foreign diploma;
b. holders of a licence to practise in accordance with Article 11;
c. persons who have made themselves known by virtue of Article 15.
2. The register shall contain the data necessary to achieve the purposes listed in Article 23 paragraph 2. It shall also include sensitive data in accordance with Article 5c of the Federal Act of 25 September 2020 on Data Protection.
3 In the register, the OASI number shall be used systematically as a unique identifier of the individuals listed in it and to update the personal data.
4 The Federal Council shall issue more detailed provisions on the personal data contained in the Register and how to process them.
Article 26 of the Act on Healthcare Occupations - Data disclosure
1 The data concerning disciplinary measures and the reasons for refusal or withdrawal of licensing, by virtue of Article 14 may only be accessed by the authorities responsible for licensing to practise and by the supervisory authorities.
2 The FOPH shall pass information to the authorities responsible for current disciplinary procedures, at their request, on the data concerning lifted restrictions and temporary bans from practising marked “deleted.”
3 The OASI number shall not be accessible to the public, but only to the authority responsible for keeping the Register and to the cantonal authorities responsible for licensing to practise.

Article 11 Ordinance concerning the Healthcare Occupations Register - Communication of public data
1 The public data shall be accessible online or on request.
2 The data accessible only on request shall be identified as such in the Annex.
Article 12 Ordinance concerning the Healthcare Occupations Register - Access via a standard interface
1 The following users shall be granted access to public data via a standard interface:
a. the data suppliers in accordance with Articles 5, 8 and 9;
b. the public or private services handling statutory tasks or which can certify that they fulfil a task in the public interest in accordance with the purposes of the healthcare occupations register.
2 Providers of the data under paragraph 1a shall have access, via the standard interface, only to data relating to the healthcare occupations which fall within their field of activity and which they need to know to fulfil their assigned tasks under the Healthcare Occupations Act.
3 The services referred to in paragraph 1b shall have access, via the standard interface, only to data relating to the healthcare occupations which fall within their field of activity and which they need to know to fulfil their assigned tasks. The FOPH shall decide on access against a written application.
4 The SRC shall publish online the list of the services which, in accordance with paragraph 1b, have data access via the standard interface.
Article 3 of the Ordinance on the Healthcare Occupations Register - Database
1 The SRC shall record the following data on holders of a recognised foreign diploma in accordance with Article 10 paragraph 1 of the Healthcare Occupations Act:
a. forename(s), surname, former surname(s);
b. date of birth and sex;
c. language of correspondence;
d. nationality or nationalities;
e. diploma concerned with date, country of issue and date of recognition of diploma.
2 Concerning holders of a verified foreign diploma, in accordance with Article 15 paragraph 1 of the Healthcare Occupations Act, the SRC shall record:
a. the data referred to in paragraph 1 a to d;
b. the diploma concerned with date and country of issue and date of verification.
3 The data referred to in paragraphs 1 and 2 shall be entered free of charge and progressively on the healthcare occupations register.
Article 38 PsyPA - Responsibility
The FDHA shall keep a register showing:
a. the holders of a federal postgraduate qualification or of a recognised foreign postgraduate qualification;
b. the holders of a licence to practise psychotherapy;
c. persons who have declared their activity in accordance with Article 23.
Article 39 PsyPA - Purposes
1 The purposes of the register are as follows:
a. patient and client information and protection;
b. quality assurance;
c. compiling statistics;
d. information to foreign authorities.
2 The register also aims to streamline the procedures necessary for licensing to practise.
Article 40 PsyPA - Contents
1 The register shall contain the data necessary to pursue the set purposes. It shall include sensitive data in accordance with Article 5c of the Federal Act of 25 September 2020 on Data Protection.
2 The Federal Council shall issue provisions on the personal data contained in the register and how to process them.
Article 42 PsyPA - Data disclosure
1 The data concerning disciplinary measures and the reasons for refusal or withdrawal of licensing, by virtue of Article 26 may only be accessed by the authorities responsible for licensing to practise and by the supervisory authorities.
2 The FOPH shall pass information to the authorities responsible for current disciplinary procedures, at their request, on the data concerning lifted restrictions and temporary bans from practising marked “deleted.”
3 All other data shall be accessible to the public online.
